Any access and/or Use of the www.misterbilingue.com website implies acceptance and respect of all the terms of these Conditions and their unconditional acceptance. They therefore constitute a contract between the Service and the User.
The User is invited to read the present Terms and Conditions with the greatest attention and to read them again each time he consults the site.
In the event that the User does not wish to accept all or part of these Terms and Conditions, he or she is asked to renounce all use of the Service.

1. Definitions 2.
General Conditions of Use: refers to the present conditions to which all Users of the site, whether registered or not, must comply.
Site : refers to the website "www.misterbilingue.com".
Company: refers to SAS Mister Bilingue registered with the Paris Trade and Companies Registry under number 820 099 604.
User: Generally speaking, this refers to any Internet user of the site, whether registered or not.
Candidate User: refers to the User who holds an account on the Site in order to benefit from the recruitment services offered by the "misterbingue.com" site.
Recruiter User: refers to the User who has created his/her profile in the recruiter's area. This space enables him/her, after subscription to the paid services, to post job or internship advertisements, access the CV database, insert advertising inserts and create his/her Company Page.
CV Database: refers to the database of all Candidate Users' CVs, accessible to Recruitment Users who have subscribed to it.
2. Subject**.
The Site is intended for Candidate Users and Recruitment Users.
It allows the Candidate User to access free of charge :

The Recruiter User may purchase one of the following paid services offered on the Site:
In the event that the Recruiter User purchases one of the paid services on the Site, in addition to the General Terms and Conditions of Use, he must comply with the "General Terms and Conditions of Sale" that he will have accepted prior to his purchase.
The General Conditions of Use and the Legal Notice are accessible via links located at the foot of each of the pages of the Site.
The Site carries out an a priori control of job advertisements and the legality of the information provided. However, if a User considers that an advertisement infringes the law, he or she undertakes to report it to the Site, which will take the necessary measures.
3. Access to the Site
The Site is accessible free of charge to any User with an internet connection. All costs relating to connection to the Site are fully borne by the User.
At the time of registration, the User chooses an identifier and a password which are personal and confidential. The User undertakes to maintain their confidentiality and to assume the consequences that would result from their voluntary or involuntary disclosure. The Site declines all responsibility in the event of voluntary or involuntary transmission by the User to a third party of his or her password and access codes.
The Company implements all reasonable means to ensure quality access to the Site. However, the Company is under no obligation to do so.
Access to the Site may be suspended temporarily without notice without this interruption giving rise to any obligation or compensation to the User.
4. Intellectual property
The name of the Site is a French trademark registered since the date at the Institut National de la Propriété Industrielle (I.N.P.I) under the number 4252743.
The entire content of the Site is protected by intellectual property rights. The protected elements may include in particular: the trademarks of the Recruitment Users, photographs, drawings, videograms and logos.
Consequently, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, whether partial or complete, by any process and on any medium whatsoever of the content of the Site is prohibited, subject to the exceptions set out in article L.122.5 of the Intellectual Property Code, on pain of constituting an offence of counterfeiting liable to civil and criminal prosecution.
The company does not acquire any ownership rights to the content provided by Users. Users are the sole holders of the intellectual property rights to the intellectual works (images, videograms, texts, logos, etc.) that they publish on the Site. By publishing them on the Site, Users accept that the Company may modify their display to the public.
5. Liability of the Company
The company cannot be assimilated to an employer. The sole purpose of the Site is to put Candidate Users in contact with Recruiter Users and thus to facilitate the search for jobs and candidates.
The User is solely responsible for the proper use of the information on the site. The site cannot guarantee the accuracy or relevance of the data.
The Company cannot be held liable for the relations existing between Users and the advertisers/partners of the Site.
The Company cannot be held liable for technical problems encountered on the Site.
The existence of a link from this Site to another site in no way constitutes a validation of this site or its content on the part of the Company.
The Company cannot be held responsible for problems encountered on all other sites and/or blogs to which links are established, or for any other information published on these sites and/or blogs, as well as for the consequences of their use.
6. Responsibility and obligations of the User**.
The User must comply with these General Conditions of Use which condition access to the site. The User who does not respect the said conditions may be refused access to the Site without prior notification by the Company.
The User is solely responsible for any use of the Site, of his data made by himself for or by a third party from his account.
The use of the Site, its services and its databases is only authorised for professional purposes.
As a consequence, the User is forbidden to :
publish on the Site any information of a defamatory, insulting, disparaging, obscene, pornographic, child pornography, violent or inciting to violence, racist, xenophobic or discriminatory nature;
Create a Candidate User or Recruiter User account using the identity of a third party or a non-existent identity;
Publish false CVs, advertising or promoting products or services;
Publish misleading advertisements, advertising or for the promotion of products or services;
In the event that a User commits one of the acts listed above, the Company reserves the right to block access to all or part of the services of the Site, temporarily or permanently, without any compensation and, if the User is registered on the Site, to suspend and/or unilaterally terminate his registration.
7. Personal data
The Company undertakes to comply with the provisions of the French Data Protection Act of 6 January 1978 as amended by the Act of 6 August 2004 concerning personal information that the User communicates when using the Site.
The personal data collected on the Site is the subject of a declaration to the CNIL under the following registration number: n°1971228v0.
This data is processed in order to enable the User to create a candidate or recruiter space so that he can take advantage of the services offered by the Site. The data collected is also used for anonymous consultation statistics.
When creating his profile, the Candidate User has the possibility of refusing to see his CV and the personal data of which it is composed, appear in the CV database and be the subject of a communication to Recruitment Users. To do so, they must inform the Company.
The User agrees to be fully and personally responsible for the content of any document published on the Site and for any consequences resulting from such publication.
Users are also informed that the data they provided when registering may be used for the purpose of sending them the Site's newsletter, i.e. job offers and relevant information corresponding to their profile.
Users have the right to access, rectify and oppose their information. At any time, he may also request the deletion of his account. In order to exercise these rights, the User must prove his identity and proceed with his request at the following address: contact@misterbilingue.com.

8. Cookies.
Traffic data and cookie files are implanted in the User's computer in order to carry out internal analyses of visits to the Site's information pages to improve the content and establish statistical data (pages consulted, hours of consultation, etc.).
The User has the possibility in his browser software of opposing the recording of cookies in his computer ("private browsing" function).

9. Applicable law
Any dispute relating to the use of the Site or to the execution, interpretation or validity of these Terms and Conditions of Use is subject to French law and the French courts.
In the event of a dispute that cannot be settled amicably, only the French courts within the jurisdiction of the Paris Court of Appeal shall be competent.
